 Abstract 

The article analyzes the conclusion of the European Commission "For Democracy through Law" (the Venice Commission) on amendments to the Constitution of the Russian Federation in 2020 related to the implementation of decisions of the European Court of Human Rights in the Russian Federation. It analyzes the reasons for the amendments to Articles 79 and 125 of the Constitution of the Russian Federation, their legal nature and normative content, and sets out the conclusion of the Venice Commission of June 18, 2020. The conclusion of the Venice Commission was the desire to change or delete the amendment to Article 79 of the Constitution of the Russian Federation on the enforceability in the Russian Federation only of decisions of interstate bodies corresponding to the Constitution of the Russian Federation. Such a request cannot be fulfilled in the Russian Federation due to a number of circumstances. First, the situation with the proclamation of the supremacy of the Constitution of the Russian Federation over international legal acts and international treaties is not unique. Secondly, the Russian Federation should take care to ensure its state sovereignty, including by legal means, which are the amendments to the Constitution of the Russian Federation. Third, the powers of the Constitutional Court of the Russian Federation in terms of recognizing the constitutionality of normative legal acts and law enforcement practice cannot be limited. Finally, the decisions of the Venice Com-mission are only advisory in nature and can be considered as acts of legal assis-tance to a particular State. Thus, the article concludes that it is impossible to take into account the recommendations of the Commission in the text of the Con-stitution of the Russian Federation.
